Selling internationally creates opportunities for D2C brands, but product compliance must be considered before goods are manufactured and shipped. Requirements vary by product type, materials, intended user, claims, labeling and destination market. A product that can be sold in one market may need different testing, warnings, documentation or labeling before it can be sold elsewhere.

This guide provides a planning framework for brands sourcing from India, China, Vietnam and other Asian markets. It is not a legal checklist for every SKU; confirm specific obligations with the responsible importer, market compliance team or qualified regulatory adviser.

Start with product classification and intended use

Define what the product is, who will use it, how it will be used and what claims are made on the packaging or website. Children’s products, toys, electrical goods, cosmetics, food-contact items, furniture and textiles can each trigger different obligations. Record the product category, material composition, age grading where relevant and intended markets before the supplier begins production.

United States

US requirements are product-specific and may involve federal consumer product safety rules, children’s product requirements, labeling, textile or fiber disclosures, chemical restrictions, state-level rules and other agency requirements. For products within scope, determine whether testing, certification or a Children’s Product Certificate is required. Confirm the applicable rules and importer responsibilities for each product.

United Kingdom

The UK has its own product safety and market rules, including requirements that can differ from EU rules. Identify the applicable product legislation, responsible economic operator or importer information, instructions and warnings, marking or conformity documentation where relevant. Do not assume that an EU declaration or label automatically satisfies UK requirements.

European Union: France, Germany, Denmark and Luxembourg

For EU sales, assess the rules applicable across the single market and any country-specific language or national requirements. General product safety, chemical restrictions, textile labeling, packaging and extended producer responsibility may be relevant depending on the item. CE marking applies only to product categories covered by specific EU harmonisation legislation; it is not a general quality mark for all consumer goods.

French, German, Danish and Luxembourg market requirements may affect consumer information, instructions, warnings and packaging. Confirm required language and country-specific obligations for the product and sales channel.

Canada

Canadian obligations can include federal product safety rules, bilingual consumer information in applicable contexts, textile labeling, packaging and product-specific requirements. Provinces may add relevant rules. Confirm the applicable federal and provincial obligations before final artwork and packaging are approved.

Australia

Australia has mandatory standards and bans for certain product categories, as well as consumer law and labeling requirements. Identify whether the product is regulated and whether testing, warnings, instructions or specific product information are needed. Do not assume that a test report for another market covers Australian requirements.

Build a compliance file for every SKU

  • Product description, classification, material composition and intended use.
  • Applicable regulation and buyer standard by destination market.
  • Risk assessment, test plan and laboratory reports where required.
  • Label, packaging, warnings, instructions and claims approval.
  • Supplier declarations, traceability and relevant certificates.
  • Final approved artwork and shipment documentation.

Include compliance in supplier onboarding

Factories should receive the product compliance brief before sampling and bulk production. Agree who arranges tests, who pays, which laboratory is accepted, when testing occurs and what happens if a result fails. Review changes in material, component, factory or production site before allowing them to enter bulk production.
